The Malta Bankers’ Association (MBA) is an association of banks in Malta.

MBA believes the privacy and confidentiality as well as the security of an individual’s personal information is of paramount importance. To this effect, the MBA has developed the following privacy policy (the “Privacy Policy”) as part of our firm commitment to the privacy of users of our site (the Site) and other online services as the case may be.

MBA may need to amend this Privacy Policy from time to time in order to address new issues, to reflect changes on the Site, the activities of the Association as well as other developments. Please refer to this Privacy Policy regularly because your use of the Site signifies that you agree to be bound by the terms and conditions of this Privacy Policy, as may be amended from time to time.

 

A. Collection of Personal Information

Personal information as defined in the GDPR, means any information relating to an identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

The MBA may collect your information in different ways and for different purposes, depending on the manner you use the Site. The users of the Site may fall broadly within the following categories:

  • General users, looking for general information provided through the Site;
  • Users authorised by members – being persons employed by members or who otherwise have access to the information retained in the members’ area of the Site;
  • Event Attendees – persons wishing to attend an event MBA is organising or involved in, or otherwise, and who may register through the Site when such service is provided.

MBA collects personal information about you only when you voluntarily provide such information. As a visitor or user, we may collect the following types of information on you:

  • Contact or feedback information;
  • Information provided in pursuance of registration of seminars/conferences organised by the MBA or other third parties in conjunction with the MBA;
  • Information for the purpose of logging in to the members’ area;
  • User information;
  • Web page download information;
  • Site usage information.

 

B. Use of Personal Information

MBA will retain your personal information only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use your information to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

MBA will not sell or otherwise transfer or disclose personal information to third parties except as may be required by law, such as a court-ordered subpoena, search warrant, or other court order, or required by exigent circumstances or as may be disclosed hereunder. That means that MBA will never disclose information to third parties without your prior consent.

We may disclose your information to website hosting partners and other parties who assist us in operating the Site, conducting our business, or servicing you, so long as those parties agree to keep this information confidential.  We may also transfer your information to third parties when you are registering for an event organised by the MBA together with third parties.

We may use your personal information to tailor your experience at the Site, and to compile and display content and information that we think you might be interested in and to display content according to such preferences. MBA also may use your profile information on an aggregate basis – without personal identifiers — to provide our editors with information that is useful in developing new features and content for the Site and to provide any other party as may need be with aggregate information about our users and the usage patterns of the Site.

For users of the members’ area – By registering on, or gaining access to the members’ area of the Site, you are giving your consent to the MBA to share your information with its members and with the users  authorised by the latter. MBA may perform statistical analyses of user behaviour (on an aggregate basis) in order to measure interest in and use of the various areas of the Site.

 

C. Collection and Retention of Your Information

If you read or download information from the site, we automatically collect and store the following non-personal information:

  • The requested web page or download;
  • Whether the request was successful or not;
  • The date and time when you accessed the Site;
  • The Internet address of the web site or the domain name of the computer from which you accessed the Site;
  • The operating system of the machine running your web browser and the type and version of your web browser.

Please note that this information is strictly for the sole use of MBA through its third party sub-contractor(s) and it is not shared, leased, or sold in any manner to any other organisation.

In registering with the Site or for any services we may offer, you may be asked for different information including but not limited to:

  • Name and surname
  • Date of birth
  • Email address
  • Residential address
  • Phone or mobile number
  • Occupation, employer and position

Where registering for an event, you may be asked for financial information for the purpose of payment. Such transaction may be retained by the payment processor. Such information will not be stored by the MBA, though the MBA may be provided with a confirmation of payment processing.

You may request us to delete your information from our database by contacting us through the information provided. Nevertheless note that not all information may be deleted, as for example it may not be feasible for us to delete all traces of your activity in the system and/or any email messages received by the Secretariat.

 

D. Security and storage of your information

Your information is stored behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential. In addition, all sensitive/credit information you supply is encrypted via Secure Socket Layer (SSL) technology to enhance data privacy and help prevent loss, misuse or alteration of the information under MBA control.

Your information, including personal information, may be transferred to and maintained on computers located outside of your country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your personal information will take place to an organisation or a country unless there are adequate controls in place including the security of your data and other personal information.

 

E. Cookie Technology

MBA collects non-personal identification information using “cookie” technology and/or Internet Protocol (“IP”) address tracking. Cookies are small text files a web site can use to recognize repeat users and facilitate the user’s ongoing access to and use of the site. Non-personal identification information might include the browser used by you, the type of computer, the operating systems, the Internet service providers and other similar information. The MBA’s system also automatically gathers information about the areas you visit on the Site and about the links you may select from within the Site to other sites. MBA cannot control the use of cookies on the sites you visit using links from the Site. Most browsers are set to accept cookies. You can set yours to refuse cookies, or to alert you when cookies are being sent.

 

F. Links to other Sites

Our site has links to various other local and international organisations and agencies. Most third party sites usually have their own privacy policies or may have no policy at all. MBA has no control over the content displayed on such sites, nor over the measures, if any, that are taken by such sites to protect the privacy of your information. MBA’s Privacy Policy does not apply to such other sites.
